1. HOW TO ENTER
a. The Brandy at Apostrophe Web Giveaway will begin at 12:01 am Eastern Time (“ET”) on October 7th, 2008 and end at approximately 11:59 pm ET on October 8, 2008.
b. To participate in the contest, you may enter via the following method(s): Go to the WPEG website at http://www.power98fm.com/pages/124397.php and fill out the online entry form. Complete the entry form including your first name and last name, complete address, city, state, zip code, home telephone number, date of birth, and valid email address. All entries must be received by October 8th 2008 at 11:59 pm ET.
c. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online serve provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. For purposes of these Official rules, “receipt” of an online entry occurs when the www.power98fm.com servers record the entry information upon clicking the submit button. Any automated computer receipt (such as one confirming delivery of the e-mail) does not constitute proof of actual receipt by WPEG of an online entry for purposes of these official rules. Use of any device to automate entry is prohibited.
d. Only one Internet entry per person and one Internet entry per email address are permitted.
e. WPEG is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all persons who are twenty-five (21) years of age or older and who reside in North Carolina and South Carolina. Employees of WPEG, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Charlotte metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state and local laws and regulations.
b. Listeners are eligible to win a prize in a contest conducted by WPEG every sixty (60) days. Only one winner per household is permitted in any contest.
c. Winners must sign all required releases and present government issued photo identification in order to claim a prize.
d. Contestants are required to provide truthful information and WPEG will reject and delete any entry that it discovers to be false or fraudulent. WPEG will also disqualify any entry received from person under the minimum age requirement specified for this contest and delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. A maximum of twenty five (25) prizes will be awarded. Each prize is two (2) Access Passes valid for free admission to Club Apostrophe, 1440 South Tryon Street, Suite 101, Charlotte, NC to attend a meet and greet with artist Brandy on Friday, October 10th, 2008 from 6:00 pm to 8:00 pm. Approximate Retail Value: $20.
b. The winner will forfeit any prize or prize certificate not claimed by 5:30 pm on Friday, October 10th, 2008. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. WPEG is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the WPEG management with respect to the contest are final.
b. Twenty five (25) [winners will be selected at approximately 9:00 am ET on October 9th, 2008 in a random drawing from all eligible entries received.
c. Odds of winning depend on the number of entries received.
d. WINNERS NEED NOT LISTEN OR BE PRESENT TO WIN.
e. Winners will be contacted by phone or email after the prize drawing. If WPEG is unable to contact potential prize winner within twenty-four (24) hours of notification attempt, than the potential prize winner forfeits the prize and an alternate winner will not be selected.
f. Winner must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form by 5:30 pm ET on Friday, October 10th, 2008 or prize will be forfeited and an alternate winner will not be chosen. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. WPEG, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WPEG website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. WPEG reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of WPEG.
g. WPEG is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
